SAFEOBUDDYKIDS distributes and sells the Product in order to provide to End Users (as defined below), using third parties’ location services through IP, Wi-Fi, cellular radios and/or GPS signal provides a cloud based service that is able to generate location results that enable End Users (as defined below) to keep track of the whereabouts of their respective Watch Holders (as defined below) directly on their smartphone via a specifically downloadable application which enables the entire family share their locations with each other (the “Service” and the “App”, respectively). The Service will be provided to End Users that have an account, a Product and subscribe the Service through the App.

DEFINITIONS

In these Terms and Conditions, each of the following term shall have the meaning given to it below:

  • “End User”, “you”, “yours” and words of similar import mean or reference a parent, a legal guardian or otherwise an authorized adult that has subscribed to the Service to track the Watch Holder;
  • “Watch Holder” means any child or another person or other holder to which an End User has given the SAFEOBUDDYKIDS Product to keep track of its movements;

DEFINITIONS

1. ACCOUNT, PASSWORD, AND SECURITY

  • In order to use the Website, download and operate the App, use the Service or purchase the Product at the Website, you will need to open an account with Safeobuddykids.
  • For opening an account, you will need to,
    • Be 18 years old or over
    • Complete the registration process by providing us with current, complete and accurate information as required in the applicable registration form, including, but not limited to, your email address and contact details; and
    • Choose a password and a user name.
  • To protect your account, keep your account information and password confidential.
  • You agree to promptly update your account and other information whenever a change occurs.
  • You are responsible for all activity that occurs on or through your account.
  • You agree to notify SAFEOBUDDYKIDS without delay of any unauthorized use of your account or any other suspected breach of security.

2. SOFTWARE LICENSE

  • The Product contains software that interfaces with the App (the “Software”).
  • When you purchase the Product and accept these Terms and Condition and the Privacy Policy, you are purchasing a non-exclusive, revocable and royalty free license to use the Software, subject to these Terms and Conditions (the “License”).
  • The Software is the copyrighted work of SAFEOBUDDYKIDS or its suppliers, as applicable.  This License does not grant you any rights to use SAFEOBUDDYKIDS’s proprietary and other intellectual property relating to the Product.
  • You should respect the intellectual property rights of others when using the Software or in other software products or merchandise.  You may not, and you agree not to or enable others to, copy, decompile, reproduce, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify or create derivative works of the Software or the Product or any part SAFEOBUDDYKIDS.  Any unpermitted use, copying, decompiling, reproduction, reverse engineering, disassembly, attempt to reproduce the source code, or, otherwise, any modification or redistribution of Software is expressly prohibited and may result in severe civil and criminal penalties.  Any infringement may result in prosecution and civil proceedings in accordance with applicable laws.
  • SAFEOBUDDYKIDS Does not maked any assurance with respect to the accuracy of the results or output that derives from the use of the software.

3. PRIVACY POLICY

The Privacy Policy explains how we treat your personal data and protect your privacy when you make purchase of our product or enroll to any services available with us. Here you agree that SAFEOBUDDYKIDS may use such data in accordance with our Privacy Policy. For example, we may use Personal Information:

To provide our Service, and to process and complete any transactions;

  • To respond to your emails, submissions, questions, comments, requests, and complaints and provide customer service;
  • To monitor and analyze Site or Device usage and trends, and to personalize and improve our Site and our user experience on our Site to increase our site’s functionality and user friendliness; and
  • To send you confirmations, updates, security alerts, and support and administrative messages and otherwise facilitate your use of, and our administration and operation of our Service.

Security of Your Personal Information

  • We take commercially reasonable security measures to protect your personal information (including, preventing the loss, misuse, unauthorized access, disclosure, alteration and destruction of your personal information). Please be aware, however, that despite our efforts, no security measures are impenetrable. If you use a password on the Service, you are responsible for keeping it confidential. Do not share it with any other person. If you believe your password has been misused, please advise us immediately.

4. CHANGE TERMS

Safe’O’Buddy Kids reserves the right to change this Agreement at any time.

5. SERVICE WARRANTY

For all service orders, Safe’O’Buddy Kids warrants that:

  • Services performed will conform to their description for ninety (90) days from the date of service,
  • Except for batteries described in the sub-section below, all parts or products used in service will be free from defects in materials and workmanship for ninety (90) days from the date of service,
  • Batteries installed as part of Safe’O’Buddykids’s battery replacement service for Safe’O’Buddy This warranty is an express limited warranty.

If non-conforming service is provided or a defect arises in a replacement part or product during the applicable warranty period, Safe’O’Buddy will at its option, either

(a) Re-perform services to conform to their description

(b) Repair or replace the part or product, using parts or products that are new or equivalent to new in performance and reliability, or

(c) Refund the sums paid to Safe’O’Buddy for service.

6. SERVICE EXCLUSIONS AND DIAGNOSTIC FEE

Safe’O’Buddy Kids may charge you a diagnostic fee (including shipping charges) as described below, if Safe’O’Buddy Kids inspects your product and determines that:

  • Your product does not require service,
  • Your product has failed due to or has incompatibilities with software or data residing or recorded on your product
  • Service is required due to the failure of parts that are neither supplied by Safe’O’Buddy nor Safe’O’Buddy-branded,
  • Additional labor or parts are required that were not specified in the original estimated charges and you do not agree to authorize service based on Safe’O’Buddy’s revised estimated charges, or
  • Service cannot be performed because the serial number has been altered, defaced or removed or the product has failed due to accident, abuse, liquid spill or submersion, neglect, misuse (including faulty installation, repair, or maintenance by anyone other than Safe’O’Buddy or an Safe’O’Buddy Authorized Service Provider), unauthorized modification, extreme environment (including extreme temperature or humidity), extreme physical or electrical stress or interference, fluctuation or surges of electrical power, lightning, static electricity, fire, acts of God or other external causes (“Service Exclusions”). Safe’O’Buddy will return your product to you without servicing it and may charge you the Diagnostic Fee.

Parts and Labor: Safe’O’Buddy Kids may provide both parts and labor, but may direct that you replace certain readily installable parts yourself, as described below.

In servicing your product, Safe’O’Buddy may use parts or products that are new or refurbished and equivalent to new in performance and reliability. Safe’O’Buddy will retain the replaced part or product that is exchanged during service as its property, and the replacement part or product will become your property. Replaced parts and products are generally repairable and are exchanged or repaired by Safe’O’Buddy for value. If applicable law requires Safe’O’Buddy to return a replaced item to you, you agree to pay Safe’O’Buddy the retail cost of the replacement item and shipping.

Disclaimer

TO THE EXTENT PERMITTED UNDER THE APPLICABLE LAW:

SAFEOBUDDYKIDS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, GUARANTEES OR CONDITIONS WITH RESPECT TO THE PRODUCT OR THE SERVICE.

THE PRODUCT AND THE SERVICE ARE SOLELY WARRANTED, IF AT ALL, UNDER THE LIMITED WARRANTY.

YOU UNDERSTAND THAT YOUR PURCHASE AND USE OF THE PRODUCT AND SERVICE IS AT YOUR OWN RISK AND THAT WE PROVIDE the PRODUCT AND SERVICE ON AN “AS IS” BASIS “WITH ALL FAULTS” AND “AS AVAILABLE.”

YOU AGREE AND ACKNOWLEDGE THAT YOU ASSUME THE ENTIRE RISK

  • FOR THE USE OF AND RELIANCE ON THE SERVICE;
  • AS TO THE QUALITY AND PERFORMANCE OF THE PRODUCT AND SERVICE SHOULD THEY PROVE DEFECTIVE.

YOU FURTHER ACKNOWLEDGE THAT IT IS YOUR RESPONSIBILITY TO COMPLY WITH ALL APPLICABLE LAWS WHILE USING THE SERVICE.

  • THE ACCURACY OR TIMELINESS OF INFORMATION AVAILABLE FROM THE WEBSITE, THE APP OR THE SERVICE;
  • THE ACCURACY OF THE MAPS, LOCATION AND GPS SERVICES INCLUDED IN THE SERVICE OR OTHER CONTENTS;
  • THAT THE WEBSITE, THE APP OR SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OR THAT CONTENT LOSS WON’T OCCUR.
  • THE HEART RATE SENSOR AND ITS DATA AND INCLUDED SAFE’O’BUDDY WATCH APPS ARE NOT MEDICAL DEVICES AND ARE INTENDED FOR FITNESS PURPOSES ONLY. THEY ARE NOT DESIGNED OR INTENDED FOR USE IN THE DIAGNOSIS OF DISEASE OR OTHER CONDITIONS, OR IN THE CURE, MITIGATION, TREATMENT, OR PREVENTION OF DISEASE.

WE EXCLUDE ANY IMPLIED WARRANTIES, INCLUDING FOR MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, TITLE AND NON-INFRINGEMENT. YOU MAY HAVE CERTAIN RIGHTS UNDER YOUR LOCAL LAW. NOTHING IN THIS CONTRACT IS INTENDED TO AFFECT THOSE RIGHTS, IF THEY ARE APPLICABLE.

YOU ACKNOWLEDGE THAT COMPUTER, MOBILE DEVICES AND OTHER TELECOMMUNICATION SYSTEMS ARE NOT FAULT-FREE AND OCCASIONAL PERIODS OF DOWNTIME OCCUR.

YOU FURTHER ACKNOWLEDGE THAT THE WATCH SOFTWARE AND SERVICES ARE NOT INTENDED OR SUITABLE FOR USE IN SITUATIONS OR ENVIRONMENTS WHERE THE FAILURE OR TIME DELAYS OF, OR ERRORS OR INACCURACIES IN, THE CONTENT, DATA OR INFORMATION PROVIDED BY THE WATCH SOFTWARE OR SERVICES COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE, INCLUDING WITHOUT LIMITATION THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, LIFE SUPPORT OR WEAPONS SYSTEMS.

Limitation and Data Accuracy

  • Safe’O’BuddyKids watch needs 2G/3G/4G/5G network, it does not support VoLTE technology.
  • Location accuracy depends on the availability and quality of signals, which may be affected by buildings, natural obstacles, weather conditions, satellite availability or due to incorrect or incomplete map data as provided by the MAP provider i.e. Google.
  • Call connectivity depends on network availability.
  • Battery life depends upon the usage like calls made, messaging, tracking interval, GPS usage, step counter activation. (It is recommended not to over-charge the watch, for a better battery life).
  • The accuracy of data depends mainly upon the availability and quality of signals of satellite and GPS/ GSM/ GPRS
  • Sometimes tracking may not be that accurate because of the availability and quality of signals which are further affected by buildings, natural obstacles, weather conditions and satellite availability and this inaccuracy may be due to incorrect or incomplete map data as provided by the MAP provider viz Google
  • Due to network related issues, there can be failure or delay in call connection

Additional terms and conditions

  • Shipping and handling charges, gift wrap fees, and taxes paid (e.g., state, customs, VAT) are not refundable.
  • Customers are responsible for shipping charges and shall assume all risk of loss or damage to the Product while in transit to SAFEOBUDDYKIDS. We recommend that you use a tracking service for your protection.
  • If you return your product to SAFEOBUDDYKIDS (a) without an RMA or (b) without all parts included in the original package, SAFEOBUDDYKIDS retains the right to either refuse delivery of such return or charge you for the missing parts and/or accessories.

SAFE’O’BUDDYKIDS Watch 30 Days Satisfaction Guaranteed Return Policy

This Return and Refund Policy is valid only for customers buying from our online shop. Other customers should contact the retail stores for their own in-store return policy.

If you are not completely satisfied with your purchase for any reason, simply contact SAFEOBUDDYKIDS Customer Support (support@SAFEOBUDDYKIDS.COM) within 30 days of your order’s delivery date to request a full refund.

To qualify for a refund, all the following conditions must be met:

  • A Return Merchandise Authorization (RMA) must be requested from our customer support team within 30 days of your order’s delivery date. To request an RMA, please write to support@safeobuddykids.com.
  • Returned product(s) must be in good physical condition (not physically broken or damaged).
  • All accessories originally included with your purchase must be included with your return.

Returned product(s) must be sent in either its original packaging or packaging providing an equal degree of protection.
